Return Policy
If you buy a product from our official website, the following terms apply if you want to return your product and receive a full refund.
If you want to return your Beam, please contact us at support@beamlabsinc.com for instructions on where to return your Beam. Read the terms listed below to know if you are eligible for a return.
General
You have 14 calendar days to return an item from the date you received it. The day of reception will be determined by the tracking information.
During these 14 calendar days you must carefully handle the product and its packaging.
Your item must be in the same condition that you receive it in to be eligible for a full refund. The product must also be in the original packaging, so make sure that you include all chords, documents and packaging components when you’re repackaging Beam.
We will not issue a full refund if our inspection shows that Beam is damaged or there are parts missing for reasons not due to our error.
Shipping information
Make sure to put the inner packaging of Beam (the cylinder) into a cardboard box, which provides minimal room for the cylinder to maneuver in. This will prevent moving and damaging of the cylinder.
You are responsible for the shipping costs when returning your item. Shipping costs and handling fees are non-refundable. Use a trackable shipping method if possible. We cannot issue a refund until we have received your product in good condition.
Refund process
We will send you an email once your return is received and inspected. We will also notify you of the approval or rejection of your refund.
You should expect to receive your refund as soon as possible when we have received your Beam. A refund will be issued within a week of receiving Beam.
Warranty
If you want to replace Beam because it is damaged or has a defect, please go to our limited warranty page and read the terms.
EULA
By using the software comprised in Beam, including the official applications of Beam Labs, you agree to be bound to the terms of this End-User License Agreement (“EULA”) set out by Beam Labs B.V. (“Beam Labs”). This EULA is a legal agreement between you and Beam Labs. The Product Software is deemed irrevocably accepted upon your use of the Product Software or Product, so please read this license carefully before using Beam or downloading our applications.
This EULA governs your use and access of the Product Software. This license gives you specific rights. Limitations of liability, disclaimers and exclusions under this EULA will not apply to the extent prohibited by applicable law.
Do not use or download the software updates of Beam if you do not agree to all of the terms and conditions of this license. This EULA does not govern your use of the Site, Site Services, or Mobile Software, or your purchase of the Product (excluding the Product Software).
1. General
The software that is installed on your Beam is licensed, not sold to you, by Beam Labs for use only under the terms of this EULA. We retain all rights, including ownership, of the software and reserve all rights not expressly granted to you under this License.
Beam Labs will release future software updates that replace or supplement Beam’s software. These updates are governed under the terms of this EULA.
2. Restrictions
This EULA does not permit you to:
– Reverse engineer or reverse compile, disassemble, modify, copy (except as expressly permitted by this license) or make derivative works of any part of the Product Software (except as and only to the extent any foregoing restriction is prohibited by applicable law).
– Distribute or make the Software available over a network where it could be used by multiple devices at the same time.
– Sell, rent, sublicense, redistribute, lease or otherwise commercially exploit the Product Software, or disclose the Product Software to any third party
3. Privacy policy and the consent to use of data
Beam Labs may collect and use technical data and related information, including but not limited to system and application software and technical information about your device, that is gathered periodically to facilitate the provision of software updates and product support related to the Product Software. We may use this information as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.
Please note that at all times, your information will be treated in accordance with our Privacy Policy, which is also incorporated into this EULA. The Privacy Policy can be found here: (beamlabsinc.com/legal/privacy).
4. Termination
This EULA and the license are effective on the date you first use the Product Software or Product and shall continue for as long as you own the Product, unless the EULA is terminated under this section. Your rights under this license will terminate automatically without notice from Beam Labs if you fail to comply with any term(s) of this license. You shall cease all use of the Product Software, and destroy all copies, full or partial, of the Product Software.
5. Services, third party materials
The Product Software may enable access to Beam Labs and third-party services and web sites (collectively and individually, “Services”). The use of the Services may require internet access, accepting additional terms of service and may be subject to additional fees.
You understand that by using any of the Services, you may encounter content that may be deemed offensive, indecent or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, you agree to use the Services at your sole risk and that Beam Labs will have no liability to you for any content that may be found to be offensive, indecent, or objectionable.
Certain Services may display, include or make available content, data, information, applications or materials from third parties (“Third Party Materials”) or provide links to certain third-party websites. By using the Services, you acknowledge and agree that Beam Labs is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third Party Materials or web sites.
Beam Labs, its affiliates and subsidiaries do not warrant or endorse and do not assume and will not have any liability or responsibility to you or any other person for any third-party Services, Third Party Materials or websites, or for any other materials, products or services of third parties. Third Party Materials and links to other web sites are provided solely as a convenience to you.
Neither Beam Labs, nor any of its content providers, guarantees the availability, accuracy, completeness, reliability, or timeliness of stock information or location data, or any other data displayed by any Services.
You agree that the Services contain proprietary content, information and material that is owned by Beam Labs, the site owner and/or their licensors, and are protected by applicable intellectual property and other laws including, but not limited to copyright, and that you will not use such proprietary content, information or materials in any way whatsoever except for: permitted use of the Services and in any matter that is inconsistent with this EULA. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and you shall not exploit the Services in any unauthorized way whatsoever, including but not limited to using the Services to transmit computer viruses and malware, or by trespass or burdening network capacity. You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that Beam Labs is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that you may receive as a result of using any of the Services.
In addition, Third Party Services and Third Party Materials that may be accessed, displayed on or linked to the Product are not available in all languages or in all countries. Beam Labs makes no representation that such Services and Materials are appropriate or available for use in any particular location. To the extent you choose to use or access such Services and/or Materials, you do so at your own initiative and are responsible for compliance with any applicable laws, including, but not limited to, applicable local laws and privacy/data collection laws. Beam Labs and its licensors, reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will Beam Labs be liable for the removal of or disabling of access to any such Services. The Application Provider may also impose limits on the use of or access to certain Services, in any case and without notice or liability.
6. Disclaimer of Warranties
You expressly acknowledge and agree that use of the Product Software is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. To the maximum extent permitted by applicable law, the Product Software and any Services performed or provided by the Product Software are provided “as is” and “as available”, with all faults and without warranty of any kind, and Beam Labs and its licensors hereby disclaims all warranties and conditions with respect to the Product Software and Services, either express, implied or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, quiet enjoyment, and non-infringement of Third Party Rights. Beam Labs does not warrant against interference with your enjoyment of the Product Software and Services, that the functions contained in, or services performed or provided by, the Product Software will meet your requirements, that the operation of the Product Software and Services will be uninterrupted or error-free, that any Service will continue to be made available, that defects in the Product software or Services will be corrected. No oral or written information or advice given by Beam Labs or a Beam Labs authorized representative will create a warranty. Should the Product Software or Services prove defective, you assume the entire cost of all necessary servicing, repair or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusions and limitations may not apply to you.
7. Limitation of liability
To the extent not prohibited by applicable law, in no event will Beam Labs be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the Product Software and services or any Third Party Software or applications in conjunction with the Product and its software, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if Beam Labs has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation or exclusion of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you. In no event shall Beam Labs’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the price you’ve paid for the watch, or the amount of 500 USD. The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
8. Severability
If any provision of this EULA is unenforceable, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
9. Governing law
This EULA shall be governed by and construed in accordance with the laws of the state of The Netherlands. You agree to the non-exclusive jurisdiction of the courts in Amsterdam, The Netherlands for any disputes, claim or cause of action arising out of, or relating to or in connection with this EULA or your use of the Product’s Software, including any disputes relating to the existence or validity of this EULA, provided that you agree to submit any such disputes, claims or causes of action exclusively to the courts of Amsterdam, The Netherlands.

Warranty
This warranty policy applies to all products manufactured by or for Beam Labs B.V. (“Beam Labs”) that are purchased on the site www.beamlabsinc.com, or from an authorized reseller as directed by Beam Labs. The warranty and its obligations only apply for the original purchaser and are limited by the terms set out below.
For a period of two years from the date of your purchase, the product will be eligible under this warranty policy (“The warranty period”). Beam Labs warrants that the product will be free from defects in materials and workmanship under normal use during this warranty period.
If the Product fails the above warranty during the Warranty Period, Beam Labs will, at its sole discretion, either:
- Repair the defective product or component, or;
- Replace the defective product or component.
Beam Labs has the sole discretion to make repairs or replacements with a new or refurbished product or components. From the date of delivery of the repaired product, the product will be covered by the terms of this Warranty Policy for the longer of:
- 90 days from the date of repair or replacement; or
- The remainder of the Warranty Period.
The warranty is transferable from the original purchasers to subsequent owners, but the Warranty Period will not be extended or extended in coverage for any such transfer.
Conditions on reporting your product for warranty: In order to successfully invoke a claim under the Warranty Policy you must:
- Inform Beam Labs within the warranty period at support@beamlabsinc.com;
- Await the RMA email from Beam Labs;
- Return the product to Beam Labs, including the proof and date of purchase from beamlabsinc.com or an authorized seller as directed by Beam Labs;
- When we have received your Product, we will start an investigation concerning the defect of the Product. If our investigation shows that the Product’s defect is not caused by one of the below listed exclusions, we will start the repairs.
Your rights and this warranty
This warranty policy gives you specific legal rights. The terms of this Warranty Policy will apply to the extent permitted by applicable law.
Exclusions
The warranty does not cover consequential damages (including but not limited to loss of data or loss of income), nor compensation for activities done by yourself, such as regular maintenance, installing firmware updates or saving or restoring data.
The warranty excludes, or does not apply if:
- The serial number on the product has been altered, removed or made illegible;
- Product modifications or repairs performed by unauthorized service organizations or persons;
- The defect is the result of excessive use, outside the intended purpose;
- The product has been damaged, including but not limited to, lightning, abnormal voltage, fire, natural disaster, water, or by animals.
- The damage is caused in shipping or transit;
- Image burn-in;
- The defect is caused by abuse of the product;
- The defect is caused by environmental conditions that are not in conformance with the user manual of the product;
- Normal wear and tear;
- The product does not function properly due to problems with access to Wi-Fi networks and faults in the transmission network.
We do not warrant that the operation of the product will be error free or uninterrupted. Beam Labs is not responsible for damages arising from failure to follow instructions relating to the use of the Products.
Limitations
The warranty policy only applies to Products manufactured by or for Beam Labs and contain a valid Beam serial number.
Beam Labs shall in no event be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, including but not limited to any damages for lost data or lost profits, the replacement of equipment and property, arising from or relating to the Warranty Policy or the Product. The total cumulative liability of Beam Labs arising from or relating to the Warranty Policy or the Product will not exceed the amount paid for the product by the original purchaser. No warranties will apply after the expiration of the warranty period, whether the warranty is made implicit or explicit. To the maximum extent permitted by applicable law, Beam Labs limits the duration of any applicable implied warranties or conditions to the duration listed in this Warranty Policy.
Disclaimer
Except as stated above in this limited warranty, and to the maximum extent permitted by applicable law, Beam Labs disclaims all express, implied, and statutory warranties. All other warranties, including the implied warranties of merchantability, non-infringement of third party rights and fitness for a particular purpose, are specifically excluded. No warranties will apply after the expiration of the warranty period.
Disputes; Governing law
This Warranty Policy shall be governed by and construed in accordance with the laws of the state of The Netherlands. You agree to the non-exclusive jurisdiction of the courts in Amsterdam, The Netherlands for any disputes, claim or cause of action arising out of, or relating to or in connection with the Warranty Policy or your use of the product, including any disputes relating to the existence or validity of the Warranty Policy, provided that you agree to submit any such disputes, claims or causes of action exclusively to the courts of Amsterdam, The Netherlands.

From time to time Beam Labs develops software updates and firmware updates to improve the functioning of the Services. The installation of these files may happen automatically without any further notice. If you do not want such updates, your only remedy is to cease using and accessing the Services.

The rights granted to you by these Terms are subject to the following restrictions. You agree that you have no right to modify, reverse engineer, edit, copy, reproduce, disassemble, reverse compile or make derivative works of any part of the Services. You agree that any software that is capable and intended to harm or alter (such as, but not limited to, computer viruses and worms) a computer, mobile devices, data, the product, the product’s software and the Services may not be uploaded or distributed. You are not allowed to gain unauthorized access to the servers or networks connected to the Services. You agree not to access or use the services in order to build a similar and/or competitive service.
2. Termination
If you violate the terms of the site, Beam Labs will reserve the right to terminate service without prior notice. Beam Labs will not be liable to you and/or any third party for termination of access to our Services as a result of any violation of our Terms of Use.
3. Security information
We cannot guarantee that unauthorized third parties will never bypass our security and not gain access to personal information. You acknowledge that you provide your personal information at your own risk.
Beam Labs does not promise that the website can be interrupted, is error free, or that the use of this site will provide any specific result. Beam Labs shall have no liability for interruptions or any errors in Internet and do not guarantee that the Web Site, it’s content or any communication from Beam Labs is free from harmful elements such as viruses. Beam Labs shall have no liability for any damage suffered in these cases. Beam Labs is not responsible for typographical or graphical errors that may appear in the Services.

5. App Stores
You agree that the availability of the Mobile Apps is dependent on the third party websites/applications from which you download these apps, such as Apple’s App Store and Google’s Play Store (collectively called “APP STORES”). Each of these stores have their own terms and conditions you must agree with before downloading our Mobile Apps. If the terms of the Stores conflict with these Terms, the more restrictive terms and conditions in these Terms apply.
6. Third Party Content
Third party content is available on our website in the form of links to external web sites, such as press reviews of our product or software. You can also download third party applications on Beam, by using the Google Play Store. When using our Services, you understand and acknowledge that you will be exposed to a wide variety of sources, and we are not responsible for the safety, usefulness and accuracy of such content. You understand and acknowledge that you may be exposed by content that is indecent, offensive or inaccurate and you agree to waive any legal or equitable rights or remedies you have or may have against Beam Labs regarding this content.
7. Intellectual property information
Intellectual property rights such as copyrights, patents, trademarks and trade secrets in the product, product software and Services are owned by Beam Labs. You acknowledge and agree with this. We respect the intellectual rights of others and we ask you to do the same. Beam Labs may terminate service and access to the Services for users who infringe our intellectual property rights. You agree and acknowledge that you may not change, alter or delete any notice of copyrights, trademarks or patents mentioned in our Services.
You may only copy parts of the Services for personal use. You may not use its content in a commercial or any other public way. You shall not incorporate any of this content onto your own Web Site without prior consent of Beam Labs.
8. Indemnity
You agree to indemnify and hold harmless Beam Labs from any damages, liabilities, costs, expenses, claims or demands (including reasonable attorneys’ and professionals’ fees and litigation costs) arising out of the violation of these Terms, your use of the products and Services and your violation of any law.
The following disclaimers, exclusions, and limitations of liability under these Terms will not apply to the extent prohibited by applicable law. Some jurisdictions do not allow the exclusion of implied warranties or the exclusion or limitation of incidental or consequential damages or other rights, so those provisions of these Terms may not apply to you.

The limited warranty for our products is listed in our Warranty Policy.
Your use of the Sites and Services are at your own risk. The Services are provided on an “as is” and “as available” basis. Beam Labs expressly disclaims any warranties and conditions, including the warranty of implied merchantability, fitness for a particular purpose and the warranty of non-infringement.
Beam Labs makes no guarantee that the Services are available on an uninterrupted error-free basis, will have compatibility with your home network and computer or mobile devices. Beam Labs does not provide any warranties against viruses, spyware or malware that may be installed on your computer or mobile device.
Beam Labs will not be responsible or liable for copyright compliance, legality or decency of material contained in or accessed through the Services.
10. Limitation of liability
Beam Labs will in no event be liable for any indirect, punitive, incidental, special, consequential damages or any damages whatsoever, including any damages for lost data or lost profits, arising out or in any way connected with the Services or the product. Under no circumstances will Beam Labs be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred in connection with use of or exposure to any content posted, emailed, accessed, transmitted or otherwise made available via the services.
Beam Labs’ total cumulative liability to any third party for all damages, losses and causes of action (whether in contract, tort, including negligence and strict liability, or otherwise) exceed the greater of the purchase price of the products purchased on the site in the twelve months prior to the date of the initial claim made against Beam Labs.
Nothing in these Terms and in particular within this “Limitation of Liability” clause shall attempt to exclude liability that cannot be excluded under applicable law.
11. Dispute resolution
These Terms of Use shall be governed by and construed in accordance with the laws of The Netherlands. You agree to the non-exclusive jurisdiction of the courts in Amsterdam, The Netherlands for any disputes, claim or cause of action arising out of, or relating to or in connection with these Terms of Use or your use of our Services, including any disputes relating to the existence or validity of these Terms of Use, provided that you agree to submit any such disputes, claims or causes of action exclusively to the courts of Amsterdam, The Netherlands.
12. Waiver
Any failure by Beam Labs to exercise or enforce any right or provision of these Terms shall not be regarded as a waiver of such right or provision. If any provision of these Terms is, for any reason, held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

By accessing or using these Services, you agree to be bound to this Privacy Policy. This Privacy Policy describes information that Beam Labs collects, use, share and store, including personal information (such as your name, e-mail address and billing information, and other personal information).

We ask you to share your personal data with us for multiple purposes, including, but not limited to:

- Helping us improve our Products and Services;

- To enable us to optimize customer service and continuously improve our Services;

“We” (Beam Labs) will not share any personal information for commercial or marketing goals, which are not related to the delivery of our Products and Services, without your consent.
